Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the FanPerks website, mobile application and related services (the "Service"), operated by {{COMPANY_NAME}} (ABN {{ABN}}), trading as {{TRADING_NAME}} ("we", "us", "our"). By creating an account, subscribing or using the Service you agree to these Terms.

1. Eligibility

To use the Service you must be at least 18 years of age and a resident of Australia. By registering you warrant that you meet these requirements.

2. Your account

You are responsible for keeping your login details secure and for all activity under your account. Notify us at {{SUPPORT_EMAIL}} immediately if you believe your account has been used without your authorisation.

3. Subscription and payment

The Service is provided on a paid subscription basis at $10 (AUD) per

month, billed in advance via our payments processor.

Subscriptions automatically renew each month until cancelled. You can

cancel at any time from your profile or via the Stripe customer portal; cancellation takes effect at the end of the current billing period.

All amounts are inclusive of GST where applicable.
We may change subscription pricing on at least 30 days' notice.

4. Offers and redemptions

"Offers" are member-only deals supplied by independent third-party local

businesses ("Partners"). Partners are solely responsible for honouring their offers and the goods or services they provide.

Each offer specifies its own redemption limit and expiry date.

Redemption codes are personal to you and may not be sold or transferred.

We may remove or change an offer at any time and we accept no liability

for the conduct of any Partner.

5. Predictions and entries

The Service includes a free-to-play predictions feature in respect of

NRL fixtures. No money is wagered, no fees are charged to play, and predictions cannot be exchanged for cash.

Submitting a prediction earns you one (1) entry into the current prize

draw. A correct prediction earns three (3) additional entries. Entries are non-transferable and have no monetary value.

Match data is provided "as is" and we make no warranty as to its

accuracy or timeliness.

6. Prize draws

Prize draws are operated separately under our Prize Draw Terms and Conditions, available at /legal/prize-terms. By participating you agree to be bound by those terms.

7. Acceptable use

You agree not to:

use the Service for any unlawful purpose or in breach of these Terms;
attempt to gain unauthorised access to any account or our systems;
submit false personal information or impersonate another person;
automate or scrape the Service, or interfere with its normal operation;
misuse, sell or transfer redemption codes or entries.

We may suspend or terminate your account if we reasonably believe you have breached these Terms.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy you may have under the Australian Consumer Law (Schedule 2 of the *Competition and Consumer Act 2010* (Cth)) that cannot lawfully be excluded. Where we are entitled to do so, our liability for breach of any non-excludable consumer guarantee is limited at our option to the resupply of the relevant service or the cost of resupplying it.

9. Limitation of liability

To the maximum extent permitted by law, we exclude all implied warranties and our aggregate liability to you for any claim relating to the Service in any 12-month period is limited to the subscription fees you paid us in that period.

10. Privacy

Your personal information is collected and handled in accordance with our Privacy Policy at /legal/privacy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you in-app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Termination

You may close your account at any time. We may terminate or suspend your account on reasonable notice, or immediately for serious or repeated breaches of these Terms.

13. Governing law

These Terms are governed by the laws of {{STATE}}, Australia. The parties submit to the non-exclusive jurisdiction of the courts of that State.
