Prize Draw Terms and Conditions

1. The promoter

The promoter is {{COMPANY_NAME}} (ABN {{ABN}}) trading as {{TRADING_NAME}} of {{REGISTERED_ADDRESS}} ("Promoter").

2. Promotion type

This is a free-to-enter game of chance. No purchase is necessary to enter: free entries are available by following the alternative method described in section 5. Where required by law, the promotion is conducted under permit number {{PERMIT_NUMBER}} issued in {{STATE}}.

3. Eligibility

Entry is open to natural persons aged 18 or over, resident in Australia, who hold a current FanPerks account in good standing. Employees, officers and immediate family of the Promoter and its associated entities are not eligible.

4. Promotional period

The promotional period for each prize is the date and time the prize becomes visible in the Service through to the published draw date and time, both shown on the in-app prize page.

5. How to enter

Entries are awarded for engagement with the Service:

5 entries — initial activation of a paid subscription;
1 entry — submitting a prediction for a fixture;
3 entries — for each prediction that turns out to be correct;
1 entry — redeeming a member offer.

Free entry without subscription: send your full name, postal address, date of birth and the prize you wish to enter for to {{CONTACT_EMAIL}}. One free entry per person per prize.

6. The draw

The winner is selected by a weighted random draw run from the admin console, where each entry contributes equally to the user's chance of winning. The draw is conducted on the published draw date. Random selection uses a cryptographically secure pseudorandom function.

7. Notification of winners

The winner will be notified in the Service and at the email address on their FanPerks account within 7 days of the draw. The Promoter may also publish the winner's first name and suburb where required by permit conditions. If a winner cannot be contacted or does not claim a prize within 30 days, the Promoter may, subject to applicable State or Territory trade promotion legislation, conduct an unclaimed prize draw.

8. Prize details

Each prize, its retail value and any specific conditions are described on the relevant in-app prize page. Prizes are not transferable, exchangeable or redeemable for cash. Where the prize includes travel or accommodation, additional terms may apply (e.g. blackout dates, valid passport, behaviour of guests).

9. Tax

The Promoter takes no responsibility for any tax implications that may arise from the prize. Independent financial advice should be sought.

10. Liability

To the extent permitted by law, the Promoter excludes all liability for any loss or damage arising out of acceptance, use or misuse of any prize. Nothing in these terms limits or excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

11. Privacy

Personal information collected during the promotion is handled in accordance with our Privacy Policy at /legal/privacy. By entering you consent to the use of your information for the conduct of the promotion and, if you win, for any winner-publication requirements imposed by the relevant permit.

12. Governing law

These terms are governed by the laws of {{STATE}}, Australia.
